Welcome to whatswho. These Terms of Use ("Terms") govern your access to and use of the whatswho mobile application ("App"), developed by whatswho ("Company," "we," "us," or "our"). By downloading, installing, or using the App on iOS or Android, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
1. Acceptance of Terms
By accessing or using whatswho, you confirm that you are at least 18 years of age and possess the legal capacity to enter into these Terms. The App is not intended for children under the age of 18. If you are using the App on behalf of an entity, you represent that you have the authority to bind that entity to these Terms.
2. Description of Service
whatswho is a social analysis application that uses the Google Gemini API to analyze exported WhatsApp chat histories (.zip or .txt files). The service provides: * Relationship dynamic analysis (love, toxicity, compatibility metrics). * Personalized feedback based on selected "tones" (e.g., soft, supportive, brutal, or hardcore). * Chat simulation mode for interactive roleplay based on contact personalities. * Visual reports including radar charts, trend graphs, and behavioral markers (Red/Green Flags).
The App is provided for entertainment and informational purposes only. The insights generated by the AI are based on algorithmic interpretations and should not be taken as professional psychological, legal, or relationship advice.
3. User Accounts & Registration
Access to certain features may require the creation of a user account. You are responsible for: * Maintaining the confidentiality of your account credentials. * All activities that occur under your account. * Providing accurate and current information if prompted. We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
4. User Obligations & Acceptable Use
By using the App, you agree that: * Consent: You have obtained the explicit consent of all parties involved in a chat history before uploading that data to the App for analysis. * Ownership: You represent that you have the legal right to the files you upload. * Prohibited Content: You will not use the App to process content that is illegal, defamatory, hateful, or violates the privacy rights of others. * Restrictions: You will not attempt to reverse-engineer the App, bypass security features, or use automated systems (bots/scrapers) to access the service. * Abuse: You will not use the "brutal" or "hardcore" tone settings to harass, bully, or inflict emotional distress on others.
5. Intellectual Property Rights
The App, including its software, UI/UX design, logos, and the underlying Flutter code, is the exclusive property of whatswho. * Our License to You: We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes. * User Content: You retain all rights to the chat files you upload. By using the App, you grant us a temporary license to process this data through the Google Gemini API solely to generate your requested analysis. * AI Outputs: You own the reports and visual charts generated specifically for you, subject to your compliance with these Terms.
6. Disclaimers & Limitation of Liability
* "As-Is" Basis: The App is provided "AS IS" and "AS AVAILABLE." We make no warranties regarding the accuracy, reliability, or availability of the AI analysis. * AI Hallucinations: You acknowledge that Artificial Intelligence can produce inaccurate or "hallucinated" information. whatswho is not responsible for errors in relationship metrics or personality simulations. * Third-Party Services: The App utilizes the Google Gemini API and the share_plus package. Your use of the App is also subject to Google’s privacy and usage policies. We are not liable for any failures or data handling practices of these third parties. * Limitation of Liability: To the maximum extent permitted by law, whatswho shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data or emotional distress arising from the App’s analysis or "tones."
7. Subscriptions & Payments
whatswho is currently offered as a free service. There are no subscription fees or in-app purchases required at this time. We reserve the right to introduce paid features or change our business model in the future, subject to updating these Terms.
8. Termination
We reserve the right to terminate or suspend your access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or the Company. You may stop using the App at any time by deleting the application from your device.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is registered, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in that jurisdiction.
10. Changes to Terms
We may update these Terms from time to time to reflect changes in our service or legal requirements. We will notify you of any material changes by posting the new Terms within the App or on our website (https://whatswho.forvibe.app). Your continued use of the App after the Effective Date constitutes your acceptance of the revised Terms.
